CLUB ETHECS VACATIONS TERMS & CONDITIONS
1. Tenure of Membership and Destination Scope
The Company offers membership plans for a fixed duration of either three (3), five (5), or seven (7) years, at the sole discretion and selection of the Member. The term once selected and commenced shall be non-alterable and binding upon the Member for the entire period.
During the membership tenure, the Member shall be entitled to avail holidays to destinations strictly as enumerated in the Annexure appended to this agreement. The destinations specified in the Annexure form an integral part of this agreement, and no substitution, alteration, or exchange of destinations shall be permitted except with the prior written consent of the Company and upon such terms and conditions, including additional charges, as the Company may stipulate.
Accommodation Category: During each annual holiday availed under the membership, the Member shall be entitled to accommodation in:
- International Destinations: 3-Star Deluxe or equivalent category hotels
- Domestic Destinations (within India): 4-Star hotels or equivalent as per availability
2. Hotel Classification
The classification of hotel standards shall be determined by the Company and shall be final and binding.
3. Air Conditioning
Air conditioning availability may not be guaranteed in hotels located in hilly regions.
4. Meal Inclusions
Complimentary breakfast shall be provided at all destinations during the stay, excluding the day of arrival. Other meals shall be excluded unless expressly specified or offered under promotional schemes.
5. Check-in/Check-out
Standard hotel check-in time is 2:00 PM, and check-out time is 11:00 AM, subject to hotel policies. Early check-in or late check-out is subject to hotel management decision and may be chargeable.
6. Sightseeing Services
Each holiday trip shall include three (3) days of sightseeing services:
- International: Seat-in-Coach (SIC) basis
- Domestic: Private vehicle (excluding safaris or boat rides)
8. Entry Tickets to Attractions
Entry tickets are included. If a Member pays for tickets due to local constraints, reimbursement is possible upon valid proof submission post-trip.
9. Exclusions
Flights, visas, travel insurance, SIM cards, forex, extra meals, porterage, medical costs, tips, personal expenses, and any unspecified items are excluded.
10. Delays by Member
Missed services due to Member delays are forfeited. Re-arrangements incur additional costs.
11. Airport Transfers
Includes airport pickup and drop (SIC or private), determined by Company based on location.
12. Non-Repetition of Destinations
Each destination may be availed only once under a membership plan.
13. Advance Booking Requirement
Booking must be initiated 120 days before travel and confirmed 90 days before travel. This is non-negotiable.
14. Non-Refundability of Fees
All membership fees and EMIs are non-refundable, regardless of usage or cancellation.
15. Eligibility for Holidays
First holiday after 6 successful EMIs. Thereafter, one holiday per 6 EMI block.
16. Installment Structure
Monthly installment: ₹3,333/- per person (exclusive of GST and TCS).
17. Mode of Payment
Standing instruction (E-NACH) with designated bank is mandatory. Failure counts as default.
18. Complimentary Upgrades
Subject to availability and Company discretion.
19. Customization
Customizations are chargeable and must be paid by the Member.
20. Penalty for Payment Default
Default penalty: ₹5,000/- + 18% GST per instance. Legal recovery or termination may follow.
21. No Suspension
No pauses or deferrals. EMIs must be paid continuously.
22. Policy for Children
Children under 5 travel free. Ages 6–12 pay child charges based on destination.
23. Blackout Periods
15 Dec to 15 Jan annually is a blackout period. Other blackout dates may apply.
24. Permissible Payment Modes
No cash payments allowed. Use online methods or cheques. The Company isn’t liable for cash given to unauthorized personnel.
25. Amendments and Cancellations
Subject to hotel/transport policies. Changes may incur charges. Company may alter arrangements in emergencies or force majeure.
26. Membership Renewal
Renewal subject to prevailing fees and offers at that time.
27. Exclusive discounts available for Promocode users only.
28. Guest Certificate
Issued for ₹999 + GST. Allows another person to use the destination under Member's name.
29. Corporate Memberships
Employees with ≥3 months tenure can travel without guest certificate, with valid ID.
30. Third-Party Liability Disclaimer
The Company is not liable for third-party services (hotels, transport, etc.).
31. Governing Law and Jurisdiction
Governed by Indian law. Courts at Pune, Maharashtra have exclusive jurisdiction.
